By accessing or using our website (optionbuilder.ai), mobile applications, and related services (collectively, the “Services”), you agree to these Terms of Use (“Terms”), along with our Privacy Policy.

   If you do not agree to these Terms, you may not use the Services. Continued use of the Services constitutes acceptance of all current and future Terms.

2. Description of Services

   OptionBuilder.ai provides software tools for home service professionals to quickly create, present, and manage service options and estimates. This includes:

   1. Estimate & Option Generation – Create tailored “Good / Better / Best” or custom option packages for clients.
   2. Automated Client Communication – Send options, updates, and agreements electronically.
   3. Digital Signatures – Securely collect approvals and authorizations from clients online.

   We may update or add new features at any time. Use of certain features may require additional terms, which will be presented at the time of use.

3. Accounts and Registration

   To access most features, you must create an account and provide accurate, current information. You are responsible for:

   • Maintaining the confidentiality of your login credentials.
   • All activity under your account.
   • Notifying us immediately of unauthorized access or security breaches.

   You may not:

   • Use another person’s account without permission.
   • Register with false or misleading information.
   • Use a username that violates another person’s rights or is offensive.
4. Payments, Subscriptions, and Auto-Renewal

   Our pricing is $99 per month or $999 per year per user. All subscriptions automatically renew unless canceled before the renewal date.

   If you subscribe through the Apple App Store:

   • Payment will be charged to your Apple ID account at confirmation of purchase.
   • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
   • Your account will be charged for renewal within 24 hours prior to the end of the current period.
   • You can manage or cancel your subscription at any time in your Apple ID Account Settings.
   • Unused portions of free trials (if offered) are forfeited when you purchase a subscription.

   If you subscribe through our website:

   • Payment will be processed via your selected payment method.
   • Auto-renewal may be canceled at any time through your account settings at optionbuilder.ai.

   All fees are non-refundable except where required by law.

5. Acceptable Use

   You agree not to use the Services to:

   • Transmit unlawful, harmful, or infringing content.
   • Attempt to disrupt or damage the Services.
   • Access any area or data you are not authorized to access.
   • Use automated scripts or bots without our permission.

   We may suspend or terminate your account for violations of these Terms.

6. Intellectual Property

   All content, trademarks, and software related to the Services are owned by or licensed to Crisara Co LLC. You may use the Services only for their intended purpose. Copying, modifying, reverse-engineering, or reselling our Services without permission is prohibited.

7. User Content

   You retain ownership of content you upload or create using the Services (“User Content”). By using the Services, you grant OptionBuilder a limited license to store, process, and display your User Content as necessary to operate and improve the Services.

   We may use anonymized, aggregated data for analytics and product improvement.

8. Digital Signatures

   By using our digital signature feature, you consent to electronic transactions under applicable laws (including the U.S. E-Sign Act and UETA). Your electronic signature has the same legal effect as a handwritten signature.

   You may request paper copies of signed documents by contacting us at info@servicemvp.com (reasonable fees may apply).

9. Service Availability

   We aim to provide 24/7 access but cannot guarantee uninterrupted availability due to maintenance, outages, or events beyond our control.

    The Services may include links to third-party sites or integrations. We are not responsible for their content, policies, or practices. Use of third-party services is at your own risk.

11. Disclaimers

    The Services are provided “as is” without warranties of any kind, express or implied. We do not guarantee accuracy, reliability, or uninterrupted availability.

12. Limitation of Liability

    To the fullest extent permitted by law, OptionBuilder will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability to you will not exceed the greater of $100 or the amount you paid us in the 12 months before the claim.

13. Indemnification

    You agree to defend, indemnify, and hold harmless Crisara Co LLC, its officers, employees, and affiliates from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

14. Changes to These Terms

    We may update these Terms at any time. Material changes will be posted on our website, and your continued use of the Services after changes are posted means you accept the new Terms.

15. Governing Law & Dispute Resolution

    These Terms are governed by the laws of the State of California, without regard to conflict of laws rules. Any disputes will be resolved by binding arbitration in Los Angeles County, California, under the rules of JAMS. You waive the right to a jury trial or to participate in a class action.
